AN  ACT to amend the insurance law, in relation to written notice of the
  acknowledgement and determination of appeals

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  4802 of the insurance law is amended by adding a
new subsection (p) to read as follows:
  (P) FAILURE, BY ANY INSURER TO COMPLY WITH SUBSECTIONS (I) AND (K)  OF
THIS SECTION, SHALL RESULT IN SUCH APPEAL BEING RESOLVED IN FAVOR OF THE
INSURED.
  S 2. This act shall take effect immediately.
