BILL NUMBER:A10216 TITLE OF BILL: An act to amend the public service law, in relation to the definition of alternate energy facilities Purpose of the bill: This bill would encourage the development of new, clean alternative electric generation technologies, by reducing the regulatory burden on certain kinetic energy storage devices. Summary of provisions: Section 1 of the bill would amend Public Service Law (PSL) §2(2-b) to exempt kinetic energy storage devices utilizing flywheels or compressed air, with an electric generating capacity of less than 80 MW, from the definition of facilities giving rise to an "electric corporation" subject to the jurisdiction of the Public Service Commission (Commission). Section 2 of the bill would provide for an immediate effective date. Existing law: PSL §2(13) defines electric corporations subject to the jurisdiction of the Commission: Co-generation facilities (PSL §2(2-a)), small hydro facilities (PSL §2(2-c)), and alternate energy production facilities (PSL §2(2-b) are specifically exempted from the definition of facilities giving rise to an "electric corporation."
