AN ACT to amend the election law, in relation to write-in votes

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph 3 of  subdivision  5  of  section  7-106  of  the
election  law, as amended by chapter 244 of the laws of 2003, is amended
to read as follows:
  (3) To vote for a person whose name is  not  printed  on  this  ballot
write or stamp [his or her] THE name [on a blank line under the names of
the  candidates  for  that  office] IN THE SPACE LABELED "WRITE-IN" THAT
APPEARS AT THE BOTTOM OF THE COLUMN  OR  ROW  UNDER  THE  TITLE  OF  THE
OFFICE.
  S 2. Subparagraph 3 of paragraph (d) of subdivision 1 of section 7-122
of  the  election law, as amended by chapter 156 of the laws of 1994, is
amended to read as follows:
  3. To vote for a person whose name is not printed on this ballot write
or stamp the name in the [blank] space LABELED "WRITE-IN" which  appears
at the bottom of the column OR ROW under the title of the office.
  S  3.  Subparagraphs  1  and  3  of  paragraph (e) of subdivision 2 of
section 7-122 of the election law, as added by chapter 352 of  the  laws
of 1986, are amended to read as follows:
  1. Mark only with the [pencil supplied] WRITING UTENSILS PROVIDED with
this ballot.
  3.  To  vote  for  a  person whose name is not printed on this ballot,
write the name in the [blank]  space  LABELED  "WRITE-IN"  (TO  indicate
where on ballot the write-in line appears) [containing] WHICH APPEARS AT
THE BOTTOM OF THE COLUMN OR ROW UNDER the title of the office.
  S 4. This act shall take effect immediately.

                      [ ] is old law to be omitted.
