BILL NUMBER:A10487 TITLE OF BILL: An act to require seventy-five percent of the board members of a not- for-profit organization located in a city of a million or more to be residents of the same community in which such organization is located PURPOSE OR GENERAL IDEA OF BILL: This bill would require seventy- five percent of the board members of a not-for-profit organization in a city of a million or more to be resi- dents of the community in which the organization is located. JUSTIFICATION: Although many not-for-profit organizations exist to serve the communi- ties and neighborhoods in which they are located, there is currently no requirement in law that not-for-profit board members be residents of, or have any particular interest in, the community the not-for-profit serves. Residents of a community or neighborhood are often most familiar with the needs of their own community. In addition, by virtue of their residency, residents are more likely to be impacted by decisions that affect their community and more likely to act in the best interest of their community as a result. By requiring seventy-five percent of not-for-profit board members to reside in the community in which their organization is located, this bill will help to ensure that community residents have a stronger voice

CLARK -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to require seventy-five percent of the board members of a not- for-profit organization located in a city of a million or more to be residents of the same community in which such organization is located THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, a not-for-pro- fit organization located in a city with a population of one million or more, shall ensure that seventy-five percent of such organization's appointed board members are current residents of the community or neigh- borhood in which such organization is located.
