TITLE OF BILL: An act to amend the alcoholic beverage control law, in
relation to authorizing a one-time ninety day extension of licenses and
permits
PURPOSE: This bill allows for an entity to request a ninety day exten-
sion when applying for a renewal of their liquor license, for a fee of
$1,500.
SUMMARY OF SPECIFIC PROVISIONS: Section 109 of the alcoholic beverage
control law is amended by adding a new subdivision 3 which allows for
any applicant, when required to notify the clerk of the village, town,
or city wherein the license premises is located, not less than thirty
days prior to the submission of its application for renewal of any
license issued under this chapter, to apply to the New York State Liquor
Authority for a one-time license extension of ninety days, for a fee of
$1,500.
JUSTIFICATION: Renewals for liquor licenses issued by the State Liquor
Authority come before the clerk of the village, town, or city wherein
the license premises is located to set in motion reviews/inspections and
notifications to local agencies, as required by law, before a renewal is
granted. Those inspections/reviews include those issued by the building
department of the village, town, or city, as well as the Fire Marshal's
office. The clerk is required to notify local police that their office

AN ACT to amend the alcoholic beverage control law, in relation to
authorizing a one-time ninety day extension of licenses and permits
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 109 of the alcoholic beverage control law is
amended by adding a new subdivision 3 to read as follows:
3. WHEN, PURSUANT TO SUBDIVISION TWO OF THIS SECTION, ANY APPLICANT IS
REQUIRED TO NOTIFY THE CLERK OF THE VILLAGE, TOWN OR CITY WHEREIN THE
LICENSED PREMISES IS LOCATED, NOT LESS THAN THIRTY DAYS PRIOR TO THE
SUBMISSION OF ITS APPLICATION FOR RENEWAL OF ANY LICENSE ISSUED UNDER
THIS CHAPTER, SUCH APPLICANT MAY, FOR A FEE OF ONE THOUSAND FIVE HUNDRED
DOLLARS, APPLY TO THE AUTHORITY FOR A ONE-TIME LICENSE EXTENSION OF
NINETY DAYS. THE LIQUOR AUTHORITY SHALL MAKE SUCH RULES AS MAY BE NECES-
SARY REGARDING REQUESTS FOR EXTENSIONS AND THE TIME FOR MAKING THE SAME.
S 2. This act shall take effect on the sixtieth day after it shall
have become a law; provided, however, that effective immediately, the
addition, amendment and/or repeal of any rule or regulation necessary
for the implementation of this act on its effective date is authorized
to be made and completed on or before such date.
