TITLE  OF BILL:   An act to amend the environmental conservation law, in
relation to allowing Onondaga county to retain  twenty  percent  of  the
gross  proceeds  from  the sale of all fishing licenses sold within such
county

PURPOSE: Allows Onondaga County to retain twenty percent  of  the  gross
proceeds  from  the sale of any fishing licenses in such county in order
to fund the costs associated with  trout  stockings  activities  through
Carpenter's Brook Fish Hatchery.

SUMMARY  OF PROVISIONS: This bill amends Section 11-0715 of the environ-
mental conservation law by adding a new subdivision 7 to allow  Onondaga
County  to  retain twenty percent of the gross proceeds from the sale of
any fishing licenses sold in the county in order to fund the costs asso-
ciated with trout stockings activities through  Carpenter's  brook  fish
hatchery.

JUSTIFICATION:  Since  1938, the Onondaga County Department of Parks and
Recreation has owned and operated a fish hatchery known  as  Carpenter's
Brook.  Onondaga  County  is  the only county in New York State to stock
trout in place of the DEC efforts. Furthermore, Onondaga County has  met
all  the recommendations that the DEC has instituted in regards to trout
stocking. In 2009, the hatchery stocked about 70,000 trout into Onondaga
County's lakes, ponds and more then 100 streams providing  some  of  the

best fishing areas in the State to Onondaga residents and visitors.

Onondaga  County desires to continue operating Carpenter's Brook Fishery
at its current levels. However, the county bears the entire cost associ-
ated with fish rearing, stocking and all other operations at the  hatch-
ery.     It is becoming increasing difficult for the county to fund this
project in light of the economic downturn. This legislation would  allow
Onondaga  County  to  keep twenty percent of the annual revenue from the
sale of fishing licenses sold to residents  within  the  county  limits.
This  would  offset  and be in lieu of any expense incurred by the State
DEC should the hatchery close and State DEC then have to take over  such
stocking  of  the  ponds  and streams currently stocked by the hatchery.
Annual sales of fishing licenses in  Onondaga  amount  to  approximately
34,000  licenses,  representing  nearly $1 million dollars in revenue to
the state. This is almost double of what other  counties  in  the  State
generate.

By a resolution passed on March 2, 2010, the Onondaga County Legislature
expressed  their  desire  to  continue  operating Carpenter's Brook fish
hatchery and their support for this legislation.

AN ACT to amend the  environmental  conservation  law,  in  relation  to
  allowing  Onondaga  county  to  retain  twenty  percent  of  the gross
  proceeds from the sale of all fishing licenses sold within such county

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  11-0715 of the environmental conservation law is
amended by adding a new subdivision 7 to read as follows:
  7. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COUNTY OF  ONONDAGA
MAY  RETAIN  TWENTY  PERCENT  OF THE GROSS PROCEEDS FROM THE SALE OF ALL
FISHING LICENSES SOLD TO RESIDENTS OF THE COUNTY OF  ONONDAGA,  TO  FUND
THE COSTS ASSOCIATED WITH TROUT STOCKING ACTIVITIES.
  S 2. This act shall take effect immediately.
