TITLE OF BILL: An act to amend the vehicle and traffic law, in relation
to increasing fines for speeding violations when a child aged fifteen
years or less is present
PURPOSE: Increases fines for speeding violations when a child aged
fifteen years or less is present in the car.
SUMMARY OF PROVISIONS: Section 1 defines that this act shall be cited as
the "Child Passenger Safety Law"
Section 2 amends the vehicle and traffic law by adding a new section,
1183 that establishes if a person exceeds the speed limit by 20 mph and
has a child in the car aged fifteen or younger in the vehicle, the fine
shall be doubled.
JUSTIFICATION: A child's life can be endangered when an adult decides to
drive irresponsibly. Although law enforcement is excellent at catching
the individuals who speed, there needs to be more of a deterrent, espe-
cially when a child is in the car. If an individual exceeds the speed
limit by 20 mph or more and has a child under the age of 15 in the car,
that child is in serious danger. Doubling the fine for speeding with a
child in the car will create a deterrent for people who drive recklessly
on the road.

AN ACT to amend the vehicle and traffic law, in relation to increasing
fines for speeding violations when a child aged fifteen years or less
is present
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Short title. This act shall be known and may be cited as
the "child passenger safety act".
S 2. The vehicle and traffic law is amended by adding a new section
1183 to read as follows:
S 1183. CHILD PASSENGER SAFETY. WHERE THE COURT OR TRIBUNAL RECORDS OR
ENTERS THAT THE SPEED UPON WHICH THE CONVICTION OF A PERSON FOR VIOLAT-
ING A SPEED LIMIT ESTABLISHED BY THIS CHAPTER EXCEEDS THE APPLICABLE
SPEED LIMIT BY TWENTY MILES PER HOUR OR MORE AND A CHILD AGED FIFTEEN
YEARS OR LESS IS PRESENT IN THE VEHICLE, THE AMOUNT OF THE FINE SHALL BE
DOUBLED.
S 3. This act shall take effect on the ninetieth day after it shall
have become a law.
