AN ACT to amend the vehicle and traffic law, in relation to increasing
fines for speeding violations when a child aged fifteen years or less
is present
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Short title. This act shall be known and may be cited as
the "child passenger safety act".
S 2. The vehicle and traffic law is amended by adding a new section
1183 to read as follows:
S 1183. CHILD PASSENGER SAFETY. WHERE THE COURT OR TRIBUNAL RECORDS OR
ENTERS THAT THE SPEED UPON WHICH THE CONVICTION OF A PERSON FOR VIOLAT-
ING A SPEED LIMIT ESTABLISHED BY THIS CHAPTER EXCEEDS THE APPLICABLE
SPEED LIMIT BY TWENTY MILES PER HOUR OR MORE AND A CHILD AGED FIFTEEN
YEARS OR LESS IS PRESENT IN THE VEHICLE, THE AMOUNT OF THE FINE SHALL BE
DOUBLED.
S 3. This act shall take effect on the ninetieth day after it shall
have become a law.
