BILL NUMBER:A10903 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to licenses to sell liquors at retail for consumption on certain premises PURPOSE OR GENERAL IDEA OF BILL: This bill would allow the business establishment Cucina Romana, Inc. to obtain a liquor license. SUMMARY OF SPECIFIC PROVISIONS: This bill amends the Alcoholic Beverage Control Law, allowing issuance of a retail license for on-premises consumption of alcohol for a premises within 200 feet of a place of worship, provided that the purpose of such premises is for the sale and consumption of food or beverage, and such premises is within the bounda- ries of the borough of Manhattan as directed therein. JUSTIFICATION: While the Alcoholic Beverage Control Law prohibits the sale for on-Premises consumption of alcohol at any location within 200 feet of a place of worship, exceptions have been made for certain estab- lishments that do not pose problems for the place of worship, or the surrounding neighborhood. This bill would exempt Cucina Romana, Inc. in New York City from this provision of law thereby allowing sale and consumption of alcohol in the restaurant. PRIOR LEGISLATIVE HISTORY: New Bill.

POWELL -- read once and referred to the Committee on Economic Development, Job Creation, Commerce and Industry AN ACT to amend the alcoholic beverage control law, in relation to licenses to sell liquors at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64-a of the alcoholic beverage control law is amended by adding a new paragraph (c-2) to read as follows: (C-2) NOTWITHSTANDING THE PROVISIONS OF SUBPARAGRAPH (I) OF PARAGRAPH (A) OF THIS SUBDIVISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED EXCLUSIVELY AS A SCHOOL, CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTES A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREM- ISES AND/OR AN OVERNIGHT LODGING FACILITY LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE BOROUGH OF MANHATTAN IN THE CITY AND COUNTY OF NEW YORK, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT THE INTERSECTION FORMED BY THE EASTERLY SIDE OF FIFTH AVENUE AND THE SOUTHERLY SIDE OF EAST 117TH STREET; AND RUNNING THENCE EASTERLY ALONG THE SOUTHERLY SIDE OF EAST 117TH STREET, 110 FEET 0 INCHES; THENCE SOUTHERLY AT RIGHT ANGLES TO THE LAST MENTIONED COURSE, 100 FEET 11 INCHES; THENCE WESTERLY AT RIGHT ANGLES TO THE LAST MENTIONED COURSE, 110 FEET 0 INCHES AT RIGHT ANGLES TO THE EASTERLY SIDE OF FIFTH AVENUE; THENCE NORTHERLY ALONG THE EASTERLY SIDE OF FIFTH AVENUE AT RIGHT ANGLES TO THE LAST MENTIONED COURSE, 100 FEET 11 INCHES TO THE POINT OR PLACE OF BEGINNING. BEING KNOWN AND DESIGNATED ON THE TAX MAP OF THE CITY OF NEW YORK, FOR THE BOROUGH OF MANHATTAN, AS SECTION 6, BLOCK 1622 LOT 73 AS SAID TAX MAP WAS ON THE 26TH DAY OF NOVEMBER 1974. S 2.
