AN ACT to amend the general business law, in relation to requiring taxis
  to participate in the electronic toll collection system and to utilize
  facilities and traffic lanes established for such system

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general business law is amended by adding a new section
396-ww to read as follows:
  S 396-WW. TAXIS; PARTICIPATION IN ELECTRONIC TOLL  COLLECTION  SYSTEM.
1.  EVERY  OWNER OR OPERATOR OF A TAXI IN THIS STATE SHALL BE AN ACCOUNT
HOLDER IN THE ELECTRONIC TOLL COLLECTION SYSTEM, AND EACH TAXI  OPERATED
ON   A   PUBLIC   HIGHWAY   SHALL   BE  EQUIPPED  WITH  THE  APPROPRIATE
RECEIVER-TRANSMITTER FOR USE OF SUCH SYSTEM.
  2. EVERY TAXI SHALL USE THE APPROPRIATE FACILITIES AND  TRAFFIC  LANES
FOR  PARTICIPATION  IN  THE  ELECTRONIC TOLL COLLECTION SYSTEM. UNDER NO
CIRCUMSTANCES, SHALL A TAXI USE A  CASH  LANE  OR  ANY  OTHER  LANE  NOT
SPECIFICALLY  DESIGNATED  EXCLUSIVELY  FOR ELECTRONIC TOLL COLLECTION AT
ANY TOLL COLLECTION FACILITY AT  WHICH  ELECTRONIC  TOLL  COLLECTION  IS
AVAILABLE.
  3.  EVERY VIOLATION OF THIS SECTION IS A TRAFFIC INFRACTION PUNISHABLE
BY A FINE OF NOT LESS THAN FIFTY DOLLARS NOR MORE THAN ONE HUNDRED FIFTY
DOLLARS.
  S 2. This act shall take effect immediately.
