BILL NUMBER:A10934 TITLE OF BILL: An act to amend the education law, in relation to adjournment of school district elections and budget votes in certain school districts PURPOSE: Relates to adjournment of school district elections and budget votes in certain school districts. SUMMARY OF PROVISIONS: Section 1: Section 2022 of the education law is amended by adding a new subdivision 7. Section 2: Enacting clause. JUSTIFICATION: The Highland Falls Central School District has requested a delay in their budget vote to give them time to ascertain how much aid they will receive from the federal government Due to the fact that 93% of their taxable land is owned by the state and federal government, the Highland Falls school district relies heavily on the federal government to supplement their tax base with funding through Title VIII of the Elementary and Secondary Education Act of 1965. This bill will also provide the school district with more time to see if there is any addi- tional state aid restored in the 2010 state budget LEGISLATIVE HISTORY: New bill.

CALHOUN -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to adjournment of school district elections and budget votes in certain school districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2022 of the education law is amended by adding a new subdivision 7 to read as follows: 7. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE ANNUAL DISTRICT MEETING AND ELECTION OF THE HIGHLAND FALLS CENTRAL SCHOOL DISTRICT THAT IS SCHEDULED TO BE HELD ON THE THIRD TUESDAY OF MAY, TWO THOUSAND TEN IS HEREBY ADJOURNED UNTIL THE FIRST TUESDAY IN JUNE, TWO THOUSAND TEN. THE TRUSTEES OR BOARD OF EDUCATION OF EACH SUCH SCHOOL DISTRICT SHALL PROVIDE NOTICE OF SUCH ADJOURNED MEETING TO THE QUALIFIED VOTERS IN THE MANNER PRESCRIBED FOR NOTICE OF THE ANNUAL MEETING, AND SUCH NOTICE SHALL PROVIDE FOR AN ADJOURNED BUDGET HEARING. THE ADJOURNED DISTRICT MEETING OR DISTRICT MEETING AND ELECTION SHALL BE DEEMED THE ANNUAL MEETING OR ANNUAL MEETING AND ELECTION OF THE DISTRICT FOR ALL PURPOSES UNDER THIS TITLE. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION SEVEN OF SECTION SIXTEEN HUNDRED EIGHT OR SUBDIVISION SEVEN OF SECTION SEVENTEEN HUNDRED SIXTEEN OF THIS TITLE OR ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO THE CONTRARY, IN TWO THOUSAND TEN THE HIGHLAND FALLS CENTRAL SCHOOL DISTRICT PROPERTY TAX REPORT CARD SHALL BE SUBMITTED TO THE DEPARTMENT NO LATER THAN TWENTY DAYS PRIOR TO THE DATE OF THE ADJOURNED MEETING AND THE DEPARTMENT SHALL MAKE ITS COMPILATION AVAILABLE ELECTRONICALLY AT LEAST SEVEN DAYS PRIOR TO SUCH DATE.
