BILL NUMBER:A11138 TITLE OF BILL: An act to amend the labor law, in relation to the appli- cation of the prevailing wage on certain municipal projects PURPOSE: To waive the requirement to pay prevailing wage on municipal construction projects with a total anticipated cost less than $5 million. SUMMARY OF PROVISIONS: This bill amends paragraph 4 of §220 of the labor law, adding municipal projects with a total anticipated cost of less that $5 million to the list of actions exempted from §220. JUSTIFICATION: The application of prevailing wage requirements on small municipal public construction projects often adds unnecessary cost delays to these projects. This bill would address this problem by cate- gorically exempting all municipal construction projects with a total estimated cost less than $5 million from the prevailing wage require- ments defined in §220 of the Labor Law. LOPEZ, MONTESANO, FINCH, AMEDORE -- read once and referred to the Committee on Labor AN ACT to amend the labor law, in relation to the application of the prevailing wage on certain municipal projects THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph c of subdivision 4 of section 220 of the labor law, as amended by chapter 118 of the laws of 1962, is amended and a new paragraph d is added to read as follows: c. Engineers, electricians and elevator men in the bureau of building management of the office of general services during the annual session of the legislature[.]; D. ANY PUBLIC WORKS PROJECTS WHERE THE FISCAL OFFICER HAS ANTICIPATED A TOTAL COST OF LESS THAN FIVE MILLION DOLLARS. S 2. This act shall take effect immediately.
