DESTITO, MAGEE -- Multi-Sponsored by -- M. of A. DINOWITZ, GALEF, McENENY, MORELLE, PRETLOW -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to requiring a complete public report with respect to determination by the state board of elections to close or not to open an investigation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 3-104 of the election law, as redesignated by chapter 9 of the laws of 1978, is renumbered subdivision 6 and a new subdivision 5 is added to read as follows: 5. WHENEVER THE STATE BOARD OF ELECTIONS DETERMINES TO CLOSE A CASE IN LIEU OF MAKING AN INVESTIGATION OR TO CLOSE A CASE FOLLOWING AN INVESTI- GATION, IT SHALL FILE A COMPLETE STATEMENT OF THE REASONS FOR SUCH DETERMINATION, WHICH SHALL BE A PUBLIC RECORD IN ITS OFFICE. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03553-01-9
