2009-A1174 (ACTIVE) - Summary

Provides that a person is guilty of intimidating or threatening a judge or justice when he or she by word, gesture or other means conveys to any person or any judge or justice that he or she will or will attempt to cause the harassment, injury or death of such judge or justice or any of the judge's or justice's family members.

AN ACT to amend the penal law, in relation to intimidating or  threaten-
  ing a judge or justice

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The penal law is amended by adding a new section 215.18  to
read as follows:
S 215.18 INTIMIDATING OR THREATENING A JUDGE OR JUSTICE.
  A  PERSON  IS GUILTY OF INTIMIDATING OR THREATENING A JUDGE OR JUSTICE
OF ANY COURT WHEN, BY WORD, GESTURE OR OTHER MEANS, HE OR SHE CONVEYS TO
ANY PERSON, OR TO ANY JUDGE OR JUSTICE, THAT HE  OR  SHE  WILL  OR  WILL
ATTEMPT TO CAUSE THE HARASSMENT, INJURY OR DEATH OF ANY JUDGE OR JUSTICE
OR  THE  HARASSMENT,  INJURY  OR  DEATH OF ANY MEMBER OF SUCH JUDGE'S OR
JUSTICE'S FAMILY.
  INTIMIDATING OR THREATENING A JUDGE OR JUSTICE IS A CLASS B FELONY.
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
