2009-A1251 (ACTIVE) - Summary

Enacts the University Emergency Alert Act; provides that on or before July first, two thousand ten, each institution of higher education shall, pursuant to rules and regulations promulgated by the board of regents, implement an emergency alert system in order to notify and advise students, faculty, staff, elected representatives and neighboring residents within a suitable geographic area of the institution of incidents or occurrences at the institution which, in the judgment of the institution, pose a threat to the health or safety of students, faculty, staff or neighboring residents; participation in an institution's emergency alert notification system shall be mandatory for students, faculty and staff at the institution who possess the electronic device necessary to receive the emergency alert.

AN  ACT  to amend the education law, in relation to the university emer-
  gency alert act

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. This act shall be known and may be cited as the "university
emergency alert act".
  S  2. The education law is amended by adding a new section 141 to read
as follows:
  S 141. UNIVERSITY EMERGENCY ALERT.  1.    FOR  THE  PURPOSES  OF  THIS
SECTION,  "HIGHER  EDUCATION" SHALL HAVE THE SAME MEANING AS ASCRIBED TO
SUCH TERM BY SUBDIVISION EIGHT OF SECTION TWO OF THIS TITLE.
  2. ON OR BEFORE JULY FIRST, TWO  THOUSAND  TEN,  EACH  INSTITUTION  OF
HIGHER EDUCATION SHALL, PURSUANT TO RULES AND REGULATIONS PROMULGATED BY
THE  BOARD  OF  REGENTS, IMPLEMENT AN EMERGENCY ALERT SYSTEM IN ORDER TO
NOTIFY AND ADVISE STUDENTS, FACULTY, STAFF, ELECTED REPRESENTATIVES  AND
NEIGHBORING  RESIDENTS WITHIN A SUITABLE GEOGRAPHIC AREA OF THE INSTITU-
TION OF INCIDENTS OR OCCURRENCES AT THE INSTITUTION WHICH, IN THE  JUDG-
MENT  OF  THE  INSTITUTION,  POSE  A  THREAT  TO THE HEALTH OR SAFETY OF
STUDENTS, FACULTY, STAFF OR NEIGHBORING RESIDENTS. PARTICIPATION  IN  AN
INSTITUTION'S EMERGENCY ALERT NOTIFICATION SYSTEM SHALL BE MANDATORY FOR
STUDENTS, FACULTY AND STAFF AT THE INSTITUTION WHO POSSESS THE ELECTRON-
IC DEVICE NECESSARY TO RECEIVE THE EMERGENCY ALERT.
  S 3. This act shall take effect immediately.
