AN ACT to amend the education law, in relation to establishing numerical
  criteria for the employment of guidance counselors

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 4605 of the education law is amended  by  adding  a
new subdivision 3 to read as follows:
  3.  NOTWITHSTANDING  ANY  OTHER  PROVISION OF LAW TO THE CONTRARY, THE
MINIMUM NUMBER OF CERTIFIED GUIDANCE COUNSELORS WHICH SHALL BE  EMPLOYED
BY  EACH  SCHOOL  DISTRICT  AFTER JULY FIRST, TWO THOUSAND NINE SHALL BE
BASED ON THE NUMBER OF STUDENTS ENROLLED IN SUCH DISTRICT AND  SHALL  BE
IN  ACCORDANCE WITH RULES AND REGULATIONS PROMULGATED BY THE COMMISSION-
ER.  IN PROMULGATING SUCH RULES AND REGULATIONS, THE COMMISSIONER  SHALL
SET  NUMERICALLY,  RATIOS OF GUIDANCE COUNSELORS TO STUDENTS AS HE DEEMS
NECESSARY TO CONFORM TO COMMONLY ACCEPTED  PROFESSIONAL  STANDARDS.  ANY
PERSON NEWLY EMPLOYED BY A SCHOOL DISTRICT AS A GUIDANCE COUNSELOR SHALL
BE DULY CERTIFIED AS A GUIDANCE COUNSELOR IN ACCORDANCE WITH REGULATIONS
PRESCRIBED BY THE COMMISSIONER.
  S  2. This act shall take effect July 1, 2009, provided, however, that
such rules and regulations as are necessary to implement the  provisions
of this act on its effective date shall be promulgated on or before such
date.
