AN  ACT  to  amend  the social services law, in relation to establishing
  voluntary enhanced standards for child day care

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  390-a  of  the social services law is amended by
adding two new subdivisions 5 and 6 to read as follows:
  5. IN ADDITION TO ANY OTHER REQUIREMENTS AND STANDARDS ESTABLISHED FOR
CHILD DAY CARE PURSUANT TO THIS ARTICLE,  THE  OFFICE  OF  CHILDREN  AND
FAMILY SERVICES SHALL ESTABLISH STANDARDS FOR A VOLUNTARY ENHANCED LEVEL
OF  CARE TO BE PROVIDED BY CHILD DAY CARE. SUCH ENHANCED STANDARDS SHALL
INCLUDE, BUT NOT  BE  LIMITED  TO  PROVISIONS  ESTABLISHING  STAFF/CHILD
RATIOS,  STAFF  QUALIFICATIONS,  PARENTAL  INVOLVEMENT,  OPERATIONAL AND
PERSONNEL POLICIES, DEVELOPMENTALLY APPROPRIATE CURRICULA, AND  FACILITY
SQUARE FOOTAGE.
  6.  IN  ADDITION  TO THE PROVISIONS OF SECTION THREE HUNDRED NINETY OF
THIS TITLE, THE OFFICE OF CHILDREN AND FAMILY  SERVICES  SHALL  ISSUE  A
RATED  LICENSE  TO  ANY  CHILD  CARE  FACILITY WHICH MEETS THE STANDARDS
ESTABLISHED BY THIS ARTICLE. THE RATING SHALL BE BASED ON PROGRAM STAND-
ARDS, EDUCATION LEVEL OF STAFF, AND COMPLIANCE OF THE CHILD CARE FACILI-
TY.
  S 2. This act shall take effect immediately.
