AN ACT to amend the penal law, in relation to the crime of disseminating
  indecent material to minors in the first degree

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  1  of  section  235.22  of the penal law, as
amended by chapter 8 of the laws of 2007, is amended to read as follows:
  1. knowing the character and content of the  communication  which,  in
whole  or  in  part,  depicts or describes, either in words, PICTURES or
images actual or simulated nudity, sexual  conduct  or  sado-masochistic
abuse, and which is harmful to minors, he intentionally uses any comput-
er  communication  system  allowing  the  input,  output, examination or
transfer, of computer data or computer programs  from  one  computer  to
another,  to  initiate or engage in such communication with a person who
is a minor; and
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
