AN ACT to amend the environmental conservation law, in relation  to  the
  waste tire management and recycling fee

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1  of  section  27-1913  of  the  environmental
conservation  law,  as  amended by section 2 of part E1 of chapter 63 of
the laws of 2003, is amended to read as follows:
  1. Until December thirty-first, two thousand ten, a waste tire manage-
ment and recycling fee of two dollars and fifty cents shall  be  charged
on  each  new  tire  sold. The fee shall be paid by the purchaser to the
tire service at the time the new tire or new motor vehicle is purchased.
  The waste tire management and recycling fee does not apply to:
  (a) recapped or resold tires; OR
  (b) [mail-order sales; or
  (c)] the sale of new motor vehicle tires to a person  solely  for  the
purpose  of  resale provided the subsequent retail sale in this state is
subject to such fee.
  S 2. This act shall take effect March 1, 2010.
