AN  ACT  to  amend  the  real property tax law, in relation to providing
  state aid to school districts within local governments  which  provide
  community housing opportunities (HOMESTAR)

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The real property tax  law  is  amended  by  adding  a  new
section 1306-c to read as follows:
  S  1306-C. COMMUNITY HOUSING INCENTIVE AID (HOMESTAR). 1. FOR PURPOSES
OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS:
  A. "COMMUNITY HOUSING" SHALL MEAN HOUSING UNITS  PRODUCED  EXCLUSIVELY
FOR  HOUSEHOLDS WITH INCOMES AT OR BELOW THE MEDIAN HOUSEHOLD INCOME FOR
THE COUNTY IN WHICH THEY ARE LOCATED.
  B. "LOCAL GOVERNMENT" SHALL MEAN A CITY, TOWN, OR VILLAGE.
  C. "DIVISION"  SHALL  MEAN  THE  DIVISION  OF  HOUSING  AND  COMMUNITY
RENEWAL.
  D.  "INCREMENTAL  EDUCATION  EXPENSES"  SHALL  MEAN THE ANNUAL COST OF
EDUCATING THE PROJECTED NUMBER OF STUDENTS  THAT  WILL  BE  ADDED  TO  A
SCHOOL DISTRICT AS A RESULT OF THE PRODUCTION OF COMMUNITY HOUSING. SUCH
EXPENSES  SHALL  BE CALCULATED AS THE PRODUCT OF THE NUMBER OF COMMUNITY
HOUSING UNITS PRODUCED, THE HOUSING COEFFICIENT  AS  DETERMINED  BY  THE
DIVISION,  AND  THE  AVERAGE  ANNUAL EXPENDITURE PER PUPIL IN THE SCHOOL
DISTRICT IN WHICH THE COMMUNITY HOUSING IS PRODUCED.
  E. "INCREMENTAL EDUCATION REVENUES" SHALL MEAN THE ANNUAL INCREASE  IN
REVENUE  AVAILABLE TO A SCHOOL DISTRICT AS A RESULT OF THE PRODUCTION OF
COMMUNITY HOUSING. SUCH REVENUE SHALL BE CALCULATED AS THE SUM  OF  REAL
PROPERTY  TAX  REVENUE  GENERATED BY THE PRODUCTION OF COMMUNITY HOUSING
AND THE AMOUNT OF STATE AID FROM ALL  SOURCES,  EXCLUSIVE  OF  COMMUNITY
HOUSING  INCENTIVE  AID  PURSUANT  TO  THIS  SECTION,  ATTRIBUTED TO THE
INCREASE IN THE PROJECTED NUMBER OF STUDENTS THAT WILL  BE  ADDED  TO  A
SCHOOL DISTRICT AS A RESULT OF THE PRODUCTION OF COMMUNITY HOUSING.
  F.    "HOUSING COEFFICIENT" SHALL MEAN THE NUMBER OF STUDENTS THAT CAN
BE PROJECTED TO BE ADDED TO A SCHOOL  DISTRICT  FOR  EACH  NEW  UNIT  OF
