AN ACT to amend the education law, in relation to education corporations
  operation of more than one charter school

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 of section  2853  of  the  education  law  is
amended by adding a new paragraph (b-2) to read as follows:
  (B-2)  NOTWITHSTANDING  PARAGRAPH  (B-1)  OF  THIS SUBDIVISION, OR ANY
OTHER LAW, RULE OR REGULATION, A CHARTER  ENTITY  SHALL  BE  AUTHORIZED,
UPON  A  SHOWING  OF  PRIOR  ACADEMIC PERFORMANCE AND COMMUNITY NEED, TO
ALLOW AN EDUCATION CORPORATION TO OPERATE A CHARTER SCHOOL AT MORE  THAN
ONE  SITE,  PROVIDED  THAT  UPON INITIAL APPROVAL OF AN EDUCATION CORPO-
RATION, THE CHARTER ENTITY  SHALL  BE  LIMITED  TO  APPROVING  ONLY  TWO
LOCATIONS.  IN NO EVENT SHALL AN ADDITIONAL LOCATION BE AUTHORIZED UNDER
THIS SUBDIVISION UNLESS AT LEAST ONE MEMBER OF THE  COMMUNITY  IN  WHICH
SUCH  LOCATION  IS  TO  BE SITED IS A MEMBER OF THE BOARD OF TRUSTEES OF
SUCH EDUCATION CORPORATION.
  S 2. This act shall take effect immediately.
