AN  ACT to amend the workers' compensation law, in relation to liability
  for compensation of an employee exposed to anthrax in  the  course  of
  their employment

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 10 of the workers' compensation law is  amended  by
adding a new subdivision 5 to read as follows:
  5.  NOTWITHSTANDING  ANY  OTHER PROVISION OF LAW, WHERE AN EMPLOYEE IS
EXPOSED TO A SUBSTANCE WHICH THE EMPLOYER, THE STATE  OR  LOCAL  POLICE,
PARAMEDICS  OR ANY OTHER OFFICIAL HEALTH OR SAFETY AGENCY DETERMINES MAY
BE ANTHRAX, SUCH EMPLOYEE SHALL BE IMMEDIATELY ENTITLED TO ALL TREATMENT
AND CARE AS IS ORDINARILY PROVIDED  FOR  ACCIDENTS  AND  INJURIES  WHICH
OCCUR IN THE COURSE OF THEIR EMPLOYMENT, AND THE COSTS OF SUCH TREATMENT
SHALL  BE DEEMED WITHIN THE COVERAGE PROVIDED BY THE EMPLOYER'S WORKERS'
COMPENSATION CARRIER.
  S 2. This act shall take effect immediately and  shall  be  deemed  to
have been in full force and effect on and after September 11, 2001.
