2009-A2193 (ACTIVE) - Summary

Permits owners of diseased bovine animals to recover actual costs incurred for engaging the services of a licensed veterinarian for an initial evaluation and examination of such animal and creates a financial incentive of one hundred and fifty percent of the actual value of such animal as determined by the commissioner for owners transporting a diseased bovine animal to Cornell University or the New York State Veterinary College at Cornell for testing for bovine spongiform encephalopathy (BSE).

AN ACT to amend the agriculture and markets law, in relation to creating
  financial incentive for owners transporting  diseased  bovine  animals
  for examinations and testing

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 78 of the agriculture and markets law is amended by
adding two new subdivisions 3 and 4 to read as follows:
  3. ANY OWNER OF A DISEASED BOVINE ANIMAL WHO VOLUNTARILY  ENGAGES  THE
SERVICES OF A LICENSED AND AUTHORIZED VETERINARIAN FOR AN INITIAL EVALU-
ATION AND EXAMINATION OF SUCH ANIMAL, PRIOR TO ANY ACTIONS IN ACCORDANCE
WITH SUBDIVISION FOUR OF THIS SECTION, SHALL BE REIMBURSED FOR THE ACTU-
AL COST INCURRED FOR SUCH VETERINARY EVALUATION AND EXAMINATION.
  4.  ANY  OWNER  OF A DISEASED BOVINE ANIMAL WHO VOLUNTARILY TRANSPORTS
SUCH ANIMAL TO CORNELL UNIVERSITY  OR  THE  NEW  YORK  STATE  VETERINARY
COLLEGE AT CORNELL FOR SUBMISSION TO TESTING FOR BOVINE SPONGIFORM ENCE-
PHALOPATHY  (BSE) SHALL BE GIVEN A FINANCIAL INCENTIVE TO BE EQUAL TO NO
MORE THAN ONE HUNDRED FIFTY PERCENT OF THE ACTUAL VALUE OF  SUCH  ANIMAL
AS DETERMINED BY THE COMMISSIONER.
  S 2. This act shall take effect immediately.
