Proscribes conduct constituting aggravated disorderly conduct defined herein as loitering in violation of section 240.20 of the penal law on six or more occasions in the previous year or ten or more occasions in the previous two years; makes aggravated disorderly conduct a class A misdemeanor.

McENENY -- Multi-Sponsored by -- M. of A. DIAZ, HOOPER, MAYERSOHN, TOWNS -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to aggravated disorderly conduct THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 240.38 to read as follows: S 240.38 AGGRAVATED DISORDERLY CONDUCT. A PERSON IS GUILTY OF AGGRAVATED DISORDERLY CONDUCT WHEN AFTER HAVING BEEN CONVICTED OF THE VIOLATION OF SECTION 240.20 OF THIS ARTICLE ON SIX OR MORE OCCASIONS WITHIN THE PREVIOUS YEAR OR ON TEN OR MORE OCCASIONS WITHIN THE PREVIOUS TWO YEARS. AGGRAVATED DISORDERLY CONDUCT IS A CLASS A MISDEMEANOR. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
