AN  ACT  to amend the vehicle and traffic law, in relation to permitting
  drivers of qualified hybrid vehicles to travel in high occupancy vehi-
  cle lanes

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  vehicle  and  traffic law is amended by adding a new
section 1229-e to read as follows:
  S 1229-E. HIGH OCCUPANCY VEHICLE LANE; QUALIFIED HYBRID  VEHICLES.  1.
NOTWITHSTANDING  ANY OTHER PROVISION OF LAW, ANY OPERATOR OF A QUALIFIED
HYBRID VEHICLE SHALL BE PERMITTED TO TRAVEL IN ANY HIGH OCCUPANCY  VEHI-
CLE  LANE  IN  THIS  STATE REGARDLESS OF WHETHER OR NOT THE OPERATION OF
SUCH VEHICLE MEETS THE MINIMUM OCCUPANCY REQUIREMENTS FOR SUCH LANE.
  2. FOR PURPOSES OF THIS SECTION THE FOLLOWING  TERMS  SHALL  HAVE  THE
FOLLOWING MEANINGS:
  A. THE TERM "QUALIFIED HYBRID VEHICLE" SHALL HAVE THE SAME MEANING SET
FORTH  IN  SUBPARAGRAPH  (B)  OF  PARAGRAPH  THREE  OF SUBSECTION (P) OF
SECTION SIX HUNDRED SIX OF THE TAX LAW; AND
  B. THE TERM "HIGH OCCUPANCY VEHICLE LANE" SHALL MEAN A  LANE  RESERVED
FOR  DESIGNATED  TYPES  OF VEHICLES AND/OR VEHICLES CARRYING A SPECIFIED
MINIMUM NUMBER OF OCCUPANTS.
  S 2. This act shall take effect immediately.
