BILL NUMBER:A269 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to providing notice of packaging date for meats, poultry and seafood PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to increase consumer awareness of perishable food packaging dates and store practices pertaining to such dates. SUMMARY OF SPECIFIC PROVISIONS: This bill would require retail food stores which offer for sale any perishable meat, poultry or seafood to post a conspicuous sign informing consumers of their rights with respect to the package dating of such products. JUSTIFICATION: Consumers trust and rely on the open dating of perishable food products. Unfortunately, many consumers are unaware of current industry practices regarding the open dating of food products and are not informed as to what each date represents. PHEFFER -- read once and referred to the Commit- tee on Agriculture AN ACT to amend the agriculture and markets law, in relation to provid- ing notice of packaging date for meats, poultry and seafood THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The agriculture and markets law is amended by adding a new section 213-a to read as follows: S 213-A. CONSUMER NOTICE. 1. AS USED IN THIS SECTION: "RETAIL FOOD STORE" MEANS ANY STORE SELLING FOOD AT RETAIL, WHICH STORE IS NOT PRIMA- RILY ENGAGED IN THE SALE OF FOOD FOR CONSUMPTION ON THE PREMISES. 2. A RETAIL FOOD STORE WHICH OFFERS FOR SALE FRESH OR PROCESSED MEATS, POULTRY OR SEAFOOD SHALL CONSPICUOUSLY POST A SIGN SITUATED SO AS TO BE CLEARLY VISIBLE TO ANY CONSUMER INSPECTING SUCH PRODUCT. THE SIGN SHALL READ: "NOTICE: YOU HAVE THE RIGHT TO KNOW WHERE AND WHEN FRESH OR PROCESSED MEATS, POULTRY OR SEAFOOD OFFERED FOR SALE WERE CUT AND PACKAGED. IN ADDITION, YOU HAVE THE RIGHT TO KNOW WHAT STORE PRACTICES ARE IN RELATION TO THE DATE MARKED ON SUCH PRODUCTS. IF YOU HAVE ANY QUESTIONS REGARDING THE PACKAGING OF THESE PRODUCTS, PLEASE SEE THE STORE MANAGEMENT OR PERSONNEL FOR ASSISTANCE." 3. SUCH SIGN SHALL BE PRINTED WITH LETTERING THAT IS LEGIBLE AND SHALL BE THREE-FOURTHS OF AN INCH BOLDFACE TYPE. S 2. This act shall take effect on the ninetieth day after it shall have become a law.
