BILL NUMBER:A277 TITLE OF BILL: An act to amend the general business law, in relation to the sale of home heating oil PURPOSE OR GENERAL IDEA OF BILL: This bill would prohibit businesses that supply heating oil to residential customers from requiring that potential customers meet a minimum level of heating oil consumption. SUMMARY OF SPECIFIC PROVISIONS: The General Business Law is amended by adding a new section 309 to prohibit businesses that supply heating oil to residential customers from requiring that potential customers meet a minimum level of heating oil consumption. Any business in violation of this section will be subject to a $500 civil penalty for each such violation. JUSTIFICATION: Escalating home energy costs have motivated many homeown- ers to invest in energy conservation. These efforts have improved the efficiency of their home and reduced the energy consumption level for the home. When shopping for fuel oil providers, homeowners are encountering compa- nies that will not extend service to the house because the household consumption number is too low. Minimum levels of use are a penalty to the residential customer that takes conservation measures seriously.

The general business law is amended by adding a new section 309 to read as follows: S 309. RESIDENTIAL HEATING OIL; MINIMUM CONSUMPTION PROHIBITED. NO PERSON, FIRM, CORPORATION, PARTNERSHIP, LIMITED PARTNERSHIP, ASSOCIATION OR OTHER BUSINESS ENGAGED IN THE BUSINESS OF DISTRIBUTING OR OTHERWISE SUPPLYING HEATING OIL TO CUSTOMERS FOR RESIDENTIAL USE SHALL REQUIRE THAT ANY PERSON MEET A MINIMUM LEVEL OF HEATING OIL CONSUMPTION TO HEAT SUCH RESIDENCE IN ORDER TO HAVE HEATING OIL DISTRIBUTED OR SUPPLIED BY SUCH HEATING OIL BUSINESS TO SUCH CUSTOMER. ANY BUSINESS IN VIOLATION OF THE PROVISIONS OF THIS SECTION SHALL BE SUBJECT TO A CIVIL PENALTY IN THE AMOUNT OF FIVE HUNDRED DOLLARS FOR EACH SUCH VIOLATION. S 2.
