2009-A3053 (ACTIVE) - Summary

Authorizes director of division of lottery to issue a license for any on-line lottery game whether known as "quick draw" or by any other name if license was previously denied because space requirements of the division were not met; also gives director authority to revoke license after one year if sales of said game are not sufficient or the game is not deemed worthwhile to the state.

AN  ACT to amend the tax law, in relation to the authority of the direc-
  tor of the division of the lottery

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  1603  of  the tax law is amended by adding a new
subdivision 6 to read as follows:
  6. THE DIRECTOR SHALL HAVE THE AUTHORITY TO ISSUE A  LICENSE  FOR  ANY
ON-LINE  LOTTERY GAME WHETHER KNOWN AS "QUICK DRAW" OR BY ANY OTHER NAME
TO ANY BUSINESS WHICH HAD BEEN PREVIOUSLY DENIED SUCH LICENSE BECAUSE IT
DID NOT MEET THE SPACE REQUIREMENTS OF THE DIVISION. THE DIRECTOR  SHALL
HAVE  THE  AUTHORITY TO REVOKE SUCH LICENSE IF THE SALES OF SUCH ON-LINE
LOTTERY GAMES BY ANY BUSINESS ARE INSUFFICIENT  TO  MEET  ADMINISTRATIVE
COSTS AND PUBLIC CONVENIENCE IS ADEQUATELY SERVED BY OTHER LICENSEES.
  S 2. This act shall take effect immediately.
