AN  ACT to amend the agriculture and markets law, in relation to storage
  of certain caustic substances

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Legislative  findings.  The  legislature hereby finds and
declares that the illegal siphoning of ammonium hydroxide  or  anhydrous
ammonia  from  privately  owned storage tanks located primarily on farms
across the state of New York is both a crime and a public health hazard.
The anhydrous ammonia is used as an  ingredient  in  the  production  of
methamphetamine,  an  illegal  dangerous stimulant drug. The legislature
further finds that too many of these storage tanks are unlocked to unau-
thorized persons. Therefore, requiring the storage tanks to be retrofit-
ted to lock to prevent unauthorized access is in the public interest.
  S 2. The agriculture and markets law is amended by adding a new  arti-
cle 14-B to read as follows:
                               ARTICLE 14-B
                  STORAGE OF CERTAIN CAUSTIC SUBSTANCES
SECTION 172-M. DEFINITIONS.
        172-N. CAUSTIC SUBSTANCE STORAGE REQUIREMENTS.
        172-O. POWER OF COMMISSIONER TO INSPECT.
        172-P. ENFORCEMENT OF ARTICLE.
        172-Q. PENALTIES FOR VIOLATIONS.
        172-R. RULES AND REGULATIONS.
        172-S. CONSTRUCTION OF ARTICLE.
  S  172-M.  DEFINITIONS.  THE  FOLLOWING TERMS SHALL HAVE THE FOLLOWING
MEANINGS:
  1. "ANHYDROUS AMMONIA" MEANS THE  DEHYDRATED  VERSION  OF  THE  LIQUID
FERTILIZER  AMMONIUM  HYDROXIDE  (NH3),  AS  DEFINED IN PARAGRAPH (1) OF
SUBDIVISION ONE OF SECTION ONE HUNDRED SEVENTY-ONE OF THIS CHAPTER.
