BENJAMIN -- read once and referred to the Commit- tee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to the sale of morning glory seeds to minors THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 399-ccc to read as follows: S 399-CCC. SALE OF MORNING GLORY SEEDS. 1. NO PERSON, FIRM, OR CORPO- RATION SHALL SELL OR OFFER TO SELL MORNING GLORY SEEDS TO ANY PERSON LESS THAN EIGHTEEN YEARS OF AGE, UNLESS SUCH PERSON IS ACCOMPANIED BY A PARENT OR GUARDIAN. 2. FOR PURPOSES OF THIS SUBDIVISION, THE TERM "MORNING GLORY SEEDS" MEANS SEEDS FROM ANY SPECIES OF THE IPOMOEA GENUS OF THE CONVOLVULACEAE FAMILY. 3. ANY PERSON, FIRM, OR CORPORATION WHO VIOLATES THE PROVISIONS OF THIS SECTION SHALL BE SUBJECT TO A CIVIL PENALTY OF NOT MORE THAN TWO HUNDRED FIFTY DOLLARS. S 2.
