AN ACT to amend the education law, in  relation  to  authorizing  school
  districts  to  utilize  funding  subject  to  contract  for excellence
  requirements in subsequent school years

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph a of subdivision 2 of section 211-d of the educa-
tion  law is amended by adding two new subparagraphs (vii) and (viii) to
read as follows:
  (VII) NOTWITHSTANDING ANY PROVISION OF THIS SECTION OR ANY OTHER  LAW,
RULE  OR  REGULATION  TO  THE CONTRARY, COMMENCING WITH THE TWO THOUSAND
SEVEN - TWO THOUSAND EIGHT SCHOOL YEAR, IF A SCHOOL DISTRICT REQUIRED TO
SUBMIT A CONTRACT FOR EXCELLENCE PURSUANT  TO  THE  PROVISIONS  OF  THIS
SECTION  IS  UNABLE  TO  UTILIZE  A  PORTION  OF  FUNDS DEDICATED TO THE
DISTRICT BECAUSE THE CONTRACT FOR EXCELLENCE WAS  NOT  APPROVED  BY  THE
COMMISSIONER UNTIL AFTER THE START OF THE SCHOOL YEAR, SAID DISTRICT MAY
UTILIZE SUCH FUNDS DURING THE NEXT TWO SUCCEEDING SCHOOL YEARS.
  (VIII) COMMENCING WITH THE TWO THOUSAND NINE - TWO THOUSAND TEN SCHOOL
YEAR,  NO  SCHOOL  DISTRICT SHALL HAVE ANY DEDICATED FUNDING CUT, DIMIN-
ISHED, OR DECREASED IN ANY MANNER DURING THE SCHOOL YEAR IN  WHICH  SUCH
CONTRACT FOR EXCELLENCE FUNDS WERE DEDICATED.
  S 2. This act shall take effect immediately.
