AN ACT in relation to directing the department of transportation and the
  metropolitan  transportation  authority  to  undertake  a study of the
  replacement of certain railroad trestles within the county of Suffolk

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Legislative  findings.  Within the county of Suffolk, the
state of New York maintains  certain  railroad  trestles  over  existing
highways  at  locations  in the town of East Hampton, county of Suffolk.
These trestles were constructed more than  a  half  century  ago.  Since
their  initial  construction the population and level of vehicle traffic
has increased significantly.   Many of these  trestles  are  located  at
major thoroughfares within the communities in which they are located.
  As  a  result, as they currently exist, these trestles present signif-
icant safety hazards to vehicular traffic and impediments  to  the  safe
flow of traffic within the community. These trestles need to be replaced
with new, modern structures that will improve the safety of traffic flow
through these corridors.
  It is the purpose of this act to direct the appropriate state agencies
to undertake a study for the replacement of these trestles and to devel-
op a plan for the implementation of such study.
  S 2. The department of transportation and the metropolitan transporta-
tion  authority  are hereby authorized and directed to undertake a study
regarding the replacement of the existing railroad trestles in the  town
of  East  Hampton,  county of Suffolk.  Such study shall be completed by
April 1, 2011 and shall be submitted to the members of  the  legislature
and the governor. Such study shall evaluate the options for the replace-
ment  of  such  trestles and shall also establish a timetable and budget
for such projects.
  S 3. This act shall take effect immediately.
