BOYLAND, DIAZ, GOTTFRIED, PEOPLES -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to the capital costs of Medgar Evers college; and to repeal paragraph (ii) of subdivision E of section 6221 of such law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision B of section 6221 of the education law, as amended by chapter 87 of the laws of 2002, is amended to read as follows: B. Senior college capital costs. Commencing with the twelve-month period beginning July first, nineteen hundred eighty-two and thereafter, the state shall pay one hundred per centum of capital costs exclusive of those financed pursuant to the provisions of article one hundred twen- ty-five-B of this chapter, of the senior colleges of the city university of New York, provided however that commencing with the twelve month period beginning July first, nineteen hundred eighty-two and thereafter, the state shall pay one hundred per centum of capital costs exclusive of those financed pursuant to the provisions of article one hundred twen- ty-five-B of this chapter, of the college of Staten Island, New York city college of technology and, commencing with the twelve month period beginning July first, [nineteen hundred ninety-four] TWO THOUSAND NINE and thereafter, [the state shall pay to the city university of New York fifty per centum of the capital costs of] Medgar Evers college, provided, however, that appropriations authorizing such costs have been approved by the legislature. The advancement of capital projects pursu- ant to this subdivision shall be undertaken only in accordance with the provisions of section ninety-three of the state finance law. [The advancement of capital projects at Medgar Evers college shall require the prior approval of the mayor of the city of New York.] EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
