Relates to the payment of a fee for polygraph and related services by persons sentenced to probation following convictions for sex offense crimes; authorizes the commissioner of the Westchester county department of probation to require a person who receives a sentence of probation following a conviction for a crime of sexual assault to pay reimbursement for the expenses related to conducting polygraphs and related services as part of a sexual offender treatment program; makes related provisions.

AN ACT to amend the executive law, in relation to the payment of  a  fee
  for  polygraph  and related services by persons sentenced to probation
  following convictions for sex offense crimes; and to amend  the  penal
  law,  in  relation  to  conditions  of  probation  and  of conditional
  discharge

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The executive law is amended by adding a new section 246-a
to read as follows:
  S 246-A. PAYMENT OF REIMBURSEMENT FOR POLYGRAPH SERVICES IN THE COUNTY
OF WESTCHESTER; SEX OFFENSE CRIMES. 1. THE COMMISSIONER OF THE WESTCHES-
TER COUNTY DEPARTMENT OF PROBATION MAY REQUIRE A PERSON WHO  RECEIVES  A
SENTENCE  OF  PROBATION  PURSUANT TO ARTICLE SIXTY-FIVE OF THE PENAL LAW
FOLLOWING A CONVICTION FOR A CRIME OF SEXUAL ASSAULT TO  PAY  REIMBURSE-
MENT  FOR  THE  EXPENSES  RELATED  TO  CONDUCTING POLYGRAPHS AND RELATED
SERVICES AS A PART OF A SEXUAL OFFENDER TREATMENT PROGRAM; PROVIDED THAT
HE OR SHE IS OF SUFFICIENT MEANS OR ABLE TO EARN SUCH MEANS.  REIMBURSE-
MENT  PAYMENTS  MADE  PURSUANT  TO  THIS SECTION SHALL BE CALCULATED AND
PAYABLE MONTHLY AND SHALL NOT EXCEED THE ACTUAL EXPENSE INCURRED BY  THE
WESTCHESTER  COUNTY DEPARTMENT OF PROBATION IN CONDUCTING SUCH POLYGRAPH
AND RELATED SERVICES. THE COMMISSIONER OF THE WESTCHESTER COUNTY DEPART-
MENT OF PROBATION MAY MAKE PAYMENT OF SUCH REIMBURSEMENT  OR  A  PORTION
THEREOF A CONDITION OF PROBATION, OR MAY DISPENSE WITH ANY SUCH PAYMENT,
AFTER   CONSIDERATION   OF   ALL   RELEVANT   FACTORS,   INCLUDING   THE
PROBATIONER'S:
  (A) FINANCIAL RESOURCES, ASSETS AND EXPENSES;
  (B) HEALTH;
  (C) AGE;
