AN  ACT  to amend the banking law, in relation to allowing credit unions
  to offer membership to the  domestic  partners  of  persons  otherwise
  eligible for membership in such credit union

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subparagraph 1 of paragraph (d) of subdivision 2 of section
451 of the banking law, as amended by chapter 660 of the laws  of  2004,
is amended to read as follows:
  (1)  in each instance where a person is a member or is directly eligi-
ble for membership, members of his or her immediate family or  household
shall be eligible for membership. For the purposes of this subparagraph,
"immediate  family"  means  a  person's  spouse OR DOMESTIC PARTNER, and
their lineal ancestors and descendants, including persons so related  by
adoption,  siblings,  stepparents,  stepchildren,  and stepsiblings; and
"household" means persons living in the same residence and maintaining a
single economic unit;
  S 2. Section 451 of the banking law is amended by adding a new  subdi-
vision 18 to read as follows:
  18.  FOR  THE  PURPOSES  OF  THIS  SECTION, "DOMESTIC PARTNER" MEANS A
PERSON WHO, WITH RESPECT TO ANOTHER PERSON:
  (A) IS FORMALLY A PARTY IN A DOMESTIC PARTNERSHIP OR SIMILAR RELATION-
SHIP WITH THE OTHER PERSON, ENTERED INTO PURSUANT TO  THE  LAWS  OF  THE
UNITED  STATES OR OF ANY STATE, LOCAL OR FOREIGN JURISDICTION, OR REGIS-
TERED AS THE DOMESTIC PARTNER OF THE  OTHER  PERSON  WITH  ANY  REGISTRY
MAINTAINED  BY  THE EMPLOYER OF EITHER PARTY OR ANY STATE, MUNICIPALITY,
OR FOREIGN JURISDICTION; OR

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
