Requires any bill or amendment substantially affecting the prison population be accompanied by a prison impact note, stating the change in the prison population resulting from the enactment of such bill, and a fiscal note on the cost thereof; defines "prison population" as the total number of individuals in the custody of the department of corrections and the office of children and family services.

AN  ACT  to  amend  the legislative law, in relation to requiring prison
  impact notes on bills affecting the prison population

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The legislative law is amended by adding a new section 52-a
to read as follows:
  S  52-A.  REQUIREMENTS  WITH  RESPECT  TO BILLS AFFECTING PRISON POPU-
LATION. 1. FOR PURPOSES OF THIS SECTION, THE  TERM  "PRISON  POPULATION"
SHALL MEAN THE TOTAL NUMBER OF INDIVIDUALS IN THE CUSTODY OF THE DEPART-
MENT  OF  CORRECTIONAL  SERVICES  AND  THE OFFICE OF CHILDREN AND FAMILY
SERVICES.
  2. ANY BILL OR AMENDMENT THAT WOULD SUBSTANTIALLY  AFFECT  THE  PRISON
POPULATION  SHALL BE ACCOMPANIED BY AN IMPACT STATEMENT, PROVIDED BY THE
SPONSOR, CONSISTING OF (A) A PRISON IMPACT NOTE STATING  THE  CHANGE  IN
POPULATION  THAT  WOULD RESULT FROM THE ENACTMENT OF SUCH BILL AND (B) A
FISCAL IMPACT NOTE STATING THE ESTIMATED  COST  OR  SAVINGS  THAT  WOULD
RESULT  FROM  THE  ENACTMENT  OF SUCH BILL. THE PRISON POPULATION IMPACT
STATEMENT SHALL IDENTIFY THE SOURCE OR SOURCES OF THESE ESTIMATES.
  S 2. This act shall take effect immediately.
