  DelMONTE -- read once and referred to the Committee on Economic Devel-
  opment, Job Creation, Commerce and Industry

AN ACT to amend the urban development corporation act,  in  relation  to
  awards under the Restore New York's Communities Initiative

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 6 of section 16-n of section 1 of  chapter  174
of the laws of 1968, constituting the urban development corporation act,
as added by section 2 of part C-2 of chapter 109 of the laws of 2006, is
amended by adding a new paragraph (e) to read as follows:
  (E)  A  MUNICIPALITY  THAT  IS  GRANTED  AN AWARD OR AWARDS UNDER THIS
SECTION SHALL GIVE PRIORITY TO MINORITY OR WOMEN OWNED  BUSINESS  ENTER-
PRISES  OR ENTERPRISES THAT ARE LOCALLY OWNED AND OPERATED IN THE AWARD-
ING OF CONTRACTS PURSUANT TO SUBDIVISIONS FOUR AND FIVE OF THIS SECTION.
PROVIDED, FURTHER, ANY BUSINESS ENTERPRISE THAT IS AWARDED A CONTRACT BY
SUCH MUNICIPALITY SHALL FIRST CONSIDER RESIDENTS  OF  THE  COMMUNITY  IN
WHICH SUCH PROPERTY OR PROPERTIES ARE LOCATED OR ARE ELIGIBLE TO PARTIC-
IPATE  IN  FEDERAL  WORKFORCE  INVESTMENT  ACT PROGRAMS PURSUANT TO P.L.
105-220 IN FILLING ANY POSITIONS OPENED AS A RESULT OF THE  AWARDING  OF
SUCH CONTRACT.
  S 2. This act shall take effect immediately.
