AN  ACT  to  amend the executive law, in relation to creating within the
  office of general services a  home  ownership  and  local  development
  program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The executive law is amended by adding a new section  201-b
to read as follows:
  S  201-B. HOME OWNERSHIP AND LOCAL DEVELOPMENT PROGRAM. 1. THERE SHALL
BE CREATED WITHIN THE OFFICE OF GENERAL SERVICES A  HOME  OWNERSHIP  AND
LOCAL DEVELOPMENT PROGRAM, WITH THE PURPOSE OF IDENTIFYING NON-ESSENTIAL
OR NON-PRESERVED STATE OWNED LAND.
  2.  THE  OFFICE  OF GENERAL SERVICES SHALL AUTHORIZE THE SALE OF STATE
OWNED LAND, IDENTIFIED AS NON-ESSENTIAL  OR  NON-PRESERVED  PURSUANT  TO
SUBDIVISION  ONE OF THIS SECTION, FOR ONE DOLLAR FOR THE CONSTRUCTION OF
AFFORDABLE HOUSING PROJECTS OR RECREATIONAL PURPOSES.
  3. SUCH STATE OWNED LAND SHALL BE LOCATED IN A  COUNTY  WITH  A  POPU-
LATION OF MORE THAN ONE THOUSAND SIX HUNDRED INHABITANTS PER SQUARE MILE
AND LESS THAN FIVE THOUSAND INHABITANTS PER SQUARE MILE ACCORDING TO THE
TWO  THOUSAND  FEDERAL  CENSUS AND SHALL NOT BE LOCATED IN A CITY WITH A
POPULATION OF ONE MILLION OR MORE INHABITANTS.
  4. SUCH STATE OWNED LAND SHALL BE TRANSFERRED TO THE APPLICABLE  CITY,
TOWN,  VILLAGE  OR  MUNICIPAL  HOUSING AUTHORITY. IF SUCH PROPERTY AFTER
TRANSFER IS NOT USED FOR AFFORDABLE  HOUSING  OR  RECREATIONAL  PURPOSES
WITHIN TWO YEARS THEN THE SALE SHALL BE VOID AND TRANSFERRED BACK TO THE
OFFICE OF GENERAL SERVICES.
  S 2. This act shall take effect on the one hundred twentieth day after
it  shall  have  become  a  law.  Any rules and regulations necessary to
implement the provisions of this act on its effective date  are  author-
ized and directed to be promulgated on or before such effective date.
