BILL NUMBER:A422 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to weight restriction violation in cities not wholly contained within one county PURPOSE OR GENERAL IDEA OF BILL: This legislation amends the distinction in penalties for overweight multi-axle vehicles between upstate counties and counties within New York City. SUMMARY OF SPECIFIC PROVISIONS: This bill amends paragraphs (b), (c) and (d) of subdivision 19 of section 385 of the vehicle and traffic law concerning fine schedules. JUSTIFICATION: This legislation provides a more equal standard of fines for vehicles which exceed multi-axle vehicle weight restrictions so that a fairer fine schedule will apply for the entire State of New York. While the proposed changes provide greater tolerance in New York City it concurrently doubles the fines for second and subsequent violations thereby providing a deterrent effect. SEMINERIO -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to weight restriction violation in cities not wholly contained within one county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (a), (c) and (d) of subdivision 19 of section 385 of the vehicle and traffic law, paragraph (a) as added by section 6 of part C of chapter 59 of the laws of 2004, the opening paragraphs of paragraphs (c) and (d) as amended by section 7 of part C of chapter 59 of the laws of 2004, and paragraphs (c) and (d) as added by chapter 929 of the laws of 1985, are amended to read as follows: (a) A violation of the provisions of subdivision eight, nine, or ten of this section by any vehicle or combination of vehicles whose weight exceeds the weight limitations as set forth in this section, or a violation of such rules and regulations, by any vehicle or combination of vehicles whose weight exceeds the weight limitations as set forth in this section or such rules and regulations, or a violation of the weight limitations specified by permit issued pursuant to subdivision fifteen of this section shall be punishable by fines levied on the registered owner of the vehicle or vehicles, whether at the time of the violation the vehicle was in the charge of the registered owner or the owner's agent or lessee in accordance with the following schedule: Percent of excess weight Amount of fine (percentage) (dollars) greater than less than or equal to 0 2.0 150 2.0 4.0 300 4.0 6.0 450 6.0 7.0 525 7.0 8.0 600 8.0 10.0 750
