S T A T E O F N E W Y O R K ________________________________________________________________________ 4304 2009-2010 Regular Sessions I N A S S E M B L Y February 3, 2009 ___________ Introduced by M. of A. CANESTRARI, CROUCH -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to limitation on expendi- tures and authorizing expenditures under a contingency budget THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1718 of the education law is amended by adding two new subdivisions 3 and 4 to read as follows: 3. NOTWITHSTANDING ANY PROVISIONS OF THE LAW TO THE CONTRARY, WHENEVER THE LEGISLATURE DOES NOT PASS A BUDGET BY THE THIRD TUESDAY IN MAY, ANY FUNDS THAT A DISTRICT RECEIVES IN EXCESS OF FUNDS APPROVED BY THE VOTERS AS A RESULT OF THE LEGISLATURE'S SUBSEQUENT PASSAGE OF A BUDGET, MAY BE SPENT ON ANY ORDINARY CONTINGENT EXPENSES. SUCH EXPENDITURES SHALL NOT BE INCLUDED FOR PURPOSES OF CALCULATING A DISTRICT'S AUTHORIZED EXPENSES UNDER A CONTINGENCY BUDGET. 4. NOTWITHSTANDING ANY PROVISIONS OF THE LAW TO THE CONTRARY, WHENEVER THE LEGISLATURE APPROVES A BUDGET SUBSEQUENT TO THE DATE OF SUBMITTAL TO THE DEPARTMENT FOR SCHOOL REPORT CARDS, DISTRICTS MAY AMEND THEIR BUDGET PROPOSALS TO REFLECT ANY INCREASED FUNDING AS A RESULT OF THE LEGISLA- TURE'S SUBSEQUENT PASSAGE OF A BUDGET.
