Defines "high purity cocaine" as any substance having a purity of seventy percent or more of cocaine and makes the sale of five hundred milligrams or more of such high purity cocaine the class A-II felony of criminal sale of a controlled substance in the second degree; defines "high purity cocaine".

AN  ACT to amend the penal law and the public health law, in relation to
  the sale of high purity cocaine

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 220.00 of the penal law is amended by adding a new
subdivision 18 to read as follows:
  18. "HIGH PURITY COCAINE" MEANS ANY AGGREGATE  OF  COMPOUNDS,  DERIVA-
TIVES,  OR PREPARATIONS THAT CONTAIN COCAINE, ITS SALTS OR ISOMERS, OF A
PURITY OF SEVENTY PERCENT OR MORE COCAINE.
  S 2. Subdivision 7 of section 220.41 of the penal law, as  amended  by
chapter  75  of  the laws of 1995, is amended and a new subdivision 8 is
added to read as follows:
  7.  methadone and the methadone weighs three hundred sixty  milligrams
or more[.]; OR
  8. FIVE HUNDRED MILLIGRAMS OR MORE OF HIGH PURITY COCAINE.
  S  3. Section 3302 of the public health law is amended by adding a new
subdivision 4-a to read as follows:
  4-A. "HIGH PURITY COCAINE" MEANS ANY AGGREGATE OF  COMPOUNDS,  DERIVA-
TIVES,  OR PREPARATIONS THAT CONTAIN COCAINE, ITS SALTS OR ISOMERS, OF A
PURITY OF SEVENTY PERCENT OR MORE COCAINE.
  S 4. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
