Requires that no snowmobile policies be implemented or trail length be altered until the completion of a survey of the existing snowmobile trails; requires the commissioner of parks, recreation and historic preservation to work in conjunction with the commissioner of environmental conservation to produce a survey of the current snowmobile trails in New York.

MORELLE -- read once and referred to the Commit- tee on Tourism, Arts and Sports Development AN ACT to amend the parks, recreation and historic preservation law and the environmental conservation law, in relation to the survey of snow- mobile trails THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The parks, recreation and historic preservation law is amended by adding a new section 21.09 to read as follows: S 21.09 SURVEY OF SNOWMOBILE TRAILS. 1. THE COMMISSIONER, IN CONSULTA- TION WITH THE COMMISSIONER OF ENVIRONMENTAL CONSERVATION, SHALL CAUSE TO BE TAKEN A SURVEY OF ALL TRAILS IN NEW YORK STATE THAT ARE CURRENTLY DESIGNATED FOR SNOWMOBILE OPERATION. NO TRAIL DESIGNATION SHALL BE REVOKED FOR THE PURPOSES OF ALTERING SURVEY RESULTS, AND NO TRAIL MILE- AGE MAY BE ADDED UNTIL SUCH SURVEY IS COMPLETED. FURTHERMORE, SUCH SURVEY SHALL INCLUDE ALL TRAILS DESIGNATED FOR SNOWMOBILE USE IN THE FOREST PRESERVE, AND THE TRANSFER OR REVOCATION OF EXISTING DESIGNATIONS FOR SNOWMOBILE TRAIL USE IN THE FOREST PRESERVE MAY NOT OCCUR IN ORDER TO MODIFY THE RESULTS OF SUCH SURVEY. 2. NO ACTION ON SNOWMOBILE TRAIL USE POLICY MAY OCCUR, NOR SHALL THE IMPLEMENTATION OF ANY COMPREHENSIVE SNOWMOBILE TRAIL POLICY OCCUR UNTIL SUCH SURVEY HAS BEEN COMPLETED, AND THE RESULTS HAVE BEEN MADE PUBLIC. 3. THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF ENVIRON- MENTAL CONSERVATION, SHALL CAUSE SUCH SURVEY TO BE COMPLETED NO LATER THAN ONE YEAR AFTER THE EFFECTIVE DATE OF THIS SECTION. S 2. The environmental conservation law is amended by adding a new section 9-0115 to read as follows: S 9-0115. SURVEY OF SNOWMOBILE TRAILS. NO ACTION ON SNOWMOBILE TRAIL USE POLICY WITHIN THE FOREST PRESERVE MAY OCCUR, NOR SHALL THE IMPLEMENTATION OF ANY COMPREHENSIVE SNOWMOBILE TRAIL POLICY OCCUR UNTIL A SNOWMOBILE TRAIL MILEAGE SURVEY HAS BEEN COMPLETED PURSUANT TO SECTION 21.09 OF THE PARKS, RECREATION AND HISTOR- IC PRESERVATION LAW. S 3. This act shall take effect immediately.
