AN ACT to amend the executive law, in relation to the training of public
  employees  for  participation  in the implementation of local disaster
  preparedness plans and the participation  of  certain  other  entities
  therein

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 23 of the executive law is amended  by  adding  two
new subdivisions 5-a and 5-b to read as follows:
  5-A. ANY COUNTY, CITY, TOWN, OR VILLAGE WHOSE PLAN INCLUDES THE USE OF
EMPLOYEES  OF  SUCH ENTITY IN DISASTER RESPONSE SHALL CERTIFY IN WRITING
TO THE STATE EMERGENCY MANAGEMENT OFFICE, AS DEFINED IN PARAGRAPH (E) OF
SUBDIVISION ONE OF SECTION TWENTY-NINE-E  OF  THIS  ARTICLE,  THAT  SUCH
EMPLOYEES  HAVE  BEEN GIVEN APPROPRIATE AND ADEQUATE TRAINING TO PERFORM
THE FUNCTIONS ASSIGNED THEM BY THE PLAN.
  5-B. ANY COUNTY, CITY, TOWN, OR VILLAGE, IN  PREPARING  A  PLAN  OR  A
REVISION  TO  A  PLAN,  SHALL  AFFIRMATIVELY  AND ACTIVELY EXTEND TO THE
FOLLOWING ENTITIES WITHIN THEIR JURISDICTIONS, WHICH LIST  IS  ILLUSTRA-
TIVE  AND NOT EXHAUSTIVE, THE OPPORTUNITY TO PARTICIPATE IN THE DEVELOP-
MENT OF A PART OF SUCH PLAN THAT WILL ADDRESS THE NEEDS OF SUCH  ENTITY,
WITH  SUCH PART'S BEING AGREED TO IN WRITING BY SUCH COUNTY, CITY, TOWN,
OR VILLAGE AND SUCH ENTITY, TO MEMORIALIZE SUCH ENTITY'S COORDINATION OF
ITS  DISASTER-RELATED  ACTIVITIES  WITH  SUCH  COUNTY,  CITY,  TOWN,  OR
VILLAGE:
  A. HOSPITALS;
  B. NURSING HOMES;
  C. SCHOOLS;
  D. SENIOR LIVING FACILITIES;
  E. ASSISTED LIVING FACILITIES;
  F. HOMELESS SHELTERS; AND

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.
