AN ACT to amend the general municipal law, in relation to discrimination
  against non-residents

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 80 of the general municipal law is amended to read
as follows:
  S 80. Discrimination against  non-residents.  1.  Any  restriction  or
regulation  imposed  by  the  governing board of a municipal corporation
upon the inhabitants of any  other  municipal  corporation  within  this
state,  carrying  on or desiring to carry on any lawful TRADE, business,
or calling within the limits thereof, which shall not be  necessary  for
the proper regulation of such trade, business, or calling, and shall not
apply  to citizens of all parts of the state alike, except ordinances or
regulations in reference to traveling circuses, shows, and  exhibitions,
shall be void.
  2.    NOTWITHSTANDING  ANY OTHER PROVISION OF LAW, NO MUNICIPAL CORPO-
RATION SHALL REQUIRE, AS A CONDITION PRECEDENT TO EMPLOYMENT OR  CONSID-
ERATION  FOR  EMPLOYMENT, ANY INDIVIDUAL TO ENTER INTO OR SIGN AN AGREE-
MENT FOR CONTRACTUAL DEBT, OR OBLIGE ANY INDIVIDUAL  IN  THE  EMPLOY  OF
SUCH  MUNICIPAL  CORPORATION  TO  PAY  ANY  TAX, FEE, OR WAGE REDUCTION,
SHOULD SUCH INDIVIDUAL BE OR BECOME A  NON-RESIDENT  OF  SUCH  MUNICIPAL
CORPORATION.  FOR  THE  PURPOSES OF THIS SECTION THE TERM "NON-RESIDENT"
SHALL MEAN AN INDIVIDUAL WHO IS NOT DOMICILED WITHIN THE LIMITS  OF  THE
EMPLOYING MUNICIPAL CORPORATION AND MAINTAINS A PERMANENT PLACE OF ABODE
ELSEWHERE. ANY RESIDENCY AGREEMENT ENTERED INTO OR SIGNED BY AN EMPLOYEE
OF A MUNICIPAL CORPORATION PRIOR TO THE EFFECTIVE DATE OF THIS PROVISION
SHALL BE VOID.
  S  2. This act shall take effect on the first of July of the year next
succeeding the year in which it shall have become a law.
