AN  ACT  to amend the public service law, in relation to requiring emer-
  gency response plans by gas and electric corporations

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The public service law is amended by adding a new section
73 to read as follows:
  S 73. EMERGENCY RESPONSE PLANS. 1. EVERY GAS OR  ELECTRIC  CORPORATION
SHALL  PREPARE  A PLAN FOR RESPONSE TO INTERRUPTIONS IN SERVICE TO MINI-
MIZE TO THE GREATEST EXTENT PRACTICABLE DAMAGES THEREFROM  TO  CUSTOMERS
AND  ALL  CITIZENS IN THE SERVICE AREA. SUCH PLAN SHALL INCLUDE, BUT NOT
BE LIMITED TO:
  (A) A SYSTEM FOR WARNING POPULATIONS WHO MAY BE  OR  ARE  IMPACTED  BY
SERVICE INTERRUPTION;
  (B)  ARRANGEMENTS  FOR  EMERGENCY  SERVICES  WHERE  THERE MAY BE HUMAN
SUFFERING;
  (C) CRITERIA FOR ESTABLISHING PRIORITIES WITH RESPECT  TO  RESTORATION
OF SERVICES;
  (D) PROVIDING INFORMATION TO THE PUBLIC;
  (E) COORDINATION STRATEGY WITH LOCAL GOVERNMENT; AND
  (F)  PROCEDURE  FOR  CUSTOMERS  TO  DOCUMENT,  REPORT  AND COLLECT FOR
DAMAGES INCURRED DUE TO SERVICE INTERRUPTION.
  2. THE COMMISSION SHALL PROMULGATE RULES AND REGULATIONS AS ARE NECES-
SARY AND APPROPRIATE TO IMPLEMENT THE PROVISIONS OF THIS SECTION.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law provided that the public  service  commission
shall  commence immediately to promulgate rules and regulations provided
for in this act.
