S T A T E O F N E W Y O R K ________________________________________________________________________ 4573 2009-2010 Regular Sessions I N A S S E M B L Y February 5, 2009 ___________ Introduced by M. of A. P. RIVERA -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to requiring the completion of a curriculum in social and emotional development and learning of children prior to certification as a teacher THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3004 of the education law is amended by adding a new subdivision 7 to read as follows: 7. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COMMISSIONER SHALL PRESCRIBE REGULATIONS REQUIRING THAT ALL PERSONS WHO APPLY, ON OR AFTER JANUARY FIRST, TWO THOUSAND ELEVEN, FOR A CERTIFICATE OR LICENSE TO BE A TEACHER SHALL, IN ADDITION TO ALL THE OTHER CERTIFICATION OR LICENSURE REQUIREMENTS, HAVE COMPLETED A CURRICULUM IN THE SOCIAL AND EMOTIONAL DEVELOPMENT AND LEARNING OF CHILDREN. SUCH CURRICULUM IN THE SOCIAL AND EMOTIONAL DEVELOPMENT AND LEARNING OF CHILDREN SHALL INCLUDE INSTRUCTION IN THE PROVISION OF COMPREHENSIVE, COORDINATED SOCIAL AND EMOTIONAL ASSESSMENTS, EARLY INTERVENTION AND TREATMENT SERVICES TO CHILDREN. EACH APPLICANT SHALL PROVIDE THE DEPARTMENT WITH DOCUMENTATION SHOWING THAT HE OR SHE HAS COMPLETED THE REQUIRED CURRICULUM, WHICH SHALL BE CONSISTENT WITH AND INCLUDE THE GUIDELINES ADOPTED PURSUANT TO SUBDIVI- SION THIRTY-FIVE OF SECTION THREE HUNDRED FIVE OF THIS CHAPTER, AS ADDED BY CHAPTER SIX HUNDRED SIXTY-SEVEN OF THE LAWS OF TWO THOUSAND SIX. IN ADDITION, SUCH INSTRUCTION SHALL INCLUDE INSTRUCTION IN CREATING CARING, SAFE, WELL-MANAGED AND PARTICIPATORY CLASSROOMS; CHILDREN'S HEALTH, SOCIAL, EMOTIONAL AND COGNITIVE DEVELOPMENT; AND TEACHING AND MODELING PURSUANT TO THE GUIDELINES ADOPTED PURSUANT TO SUBDIVISION THIRTY-FIVE OF SECTION THREE HUNDRED FIVE OF THIS CHAPTER, AS ADDED BY CHAPTER SIX HUNDRED SIXTY-SEVEN OF THE LAWS OF TWO THOUSAND SIX. S 2. This act shall take effect on the first of July next succeeding the date on which it shall have become a law. Effective immediately, any rules and regulations necessary to implement the provisions of this act on its effective date are authorized and directed to be completed on or before such date.
