2009-A4756 (ACTIVE) - Summary

Provides that no municipality, by local law, order or ordinance, shall prohibit any local government officer, employee, agent or agency from identifying or reporting to the United States bureau of immigration and customs enforcement, any person who such officer, employee, agent or agency reasonably suspect to have committed a crime or to be in violation of federal immigration laws.

AN ACT to amend the general municipal  law,  in  relation  to  reporting
  information  to  the  United  States bureau of immigration and customs
  enforcement

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  general  municipal  law  is  amended by adding a new
section 99-v to read as follows:
  S 99-V. REPORTS TO UNITED STATES BUREAU  OF  IMMIGRATION  AND  CUSTOMS
ENFORCEMENT.    NO LOCAL LAW, EXECUTIVE ORDER, OR OTHER SUCH LAW, ORDER,
OR ORDINANCE, SHALL PROHIBIT ANY  LOCAL  GOVERNMENT  OFFICER,  EMPLOYEE,
AGENT,  OR  AGENCY,  FROM IDENTIFYING OR REPORTING, TO THE UNITED STATES
BUREAU OF IMMIGRATION AND CUSTOMS ENFORCEMENT ANY  PERSON,  PURSUANT  TO
FEDERAL  LAW  OR  REGULATION,  WHO  SUCH  AGENT,  OR  AGENCY, REASONABLY
SUSPECTS TO:
  1. HAVE COMMITTED A CRIME; AND
  2. BE IN VIOLATION OF FEDERAL IMMIGRATION LAWS.
  S 2. This act shall take effect immediately.
