2009-A4864 (ACTIVE) - Summary

Defines the term "planned retirement community" to mean a contiguous parcel of privately owned real property containing two hundred or more lots which are leased to owners of year-round homes erected thereon and affixed thereto wherein the permanent occupation is restricted to tenants fifty-five years of age and older.

AN ACT to amend the real property law, in relation to planned retirement
  communities

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraph  3  of subdivision a of section 233 of the real
property law, as amended by chapter 566 of the laws of 1996, is  amended
and a new paragraph 6 is added to read as follows:
  3.  The  term  "manufactured  home  park" means a contiguous parcel of
privately owned land which is used for the  accommodation  of  three  or
more  manufactured  homes  occupied for year-round living. IT SHALL ALSO
INCLUDE A PLANNED RETIREMENT COMMUNITY.
  6. THE TERM "PLANNED RETIREMENT COMMUNITY"  SHALL  MEAN  A  CONTIGUOUS
PARCEL  OF  PRIVATELY OWNED REAL PROPERTY CONTAINING TWO HUNDRED OR MORE
LOTS WHICH ARE LEASED TO OWNERS OF YEAR-ROUND HOMES ERECTED THEREON  AND
AFFIXED  THERETO  WHEREIN  THE  PERMANENT  OCCUPATION  IS  RESTRICTED TO
TENANTS FIFTY-FIVE YEARS OF AGE AND OLDER.
  S 2. This act shall take effect immediately.
