AN  ACT  to  amend the insurance law, in relation to requiring review of
  any premium increases in excess of the consumer price index  initiated
  by an HMO

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 4308 of the insurance law is amended  by  adding  a
new subsection (k) to read as follows:
  (K) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY INCREASE OF PREMI-
UMS  IN  EXCESS  OF  THE  REGIONAL  CONSUMER  PRICE  INDEX FOR THE N.Y.,
N.Y.-NORTHEASTERN, N.J. AREA (CPI), SHALL BE REVIEWED BY THE SUPERINTEN-
DENT.
  S 2. This act shall take effect immediately.
