AN ACT to authorize the town of Brookhaven, county of Suffolk to classi-
  fy certain residential property as commercial for tax purposes

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any other provision of law to the contrary,
the town of Brookhaven, county of Suffolk,  is  authorized  to  classify
certain  residential  real property as commercial for purposes of taxing
such property at commercial rates.
  S 2. The residential real property  to  be  classified  as  commercial
shall consist of the following:
  (a) Structures with three or more residential units.
  (b)  Structures  with  two residential units which are not owner occu-
pied.
  S 3. An independent residential unit with  separate  cooking,  eating,
sanitation  and  sleeping facility in or added to a single family dwell-
ing, or located in a separate necessary structure on the same lot  as  a
single  family  dwelling  shall not be considered a residential unit for
purposes of the provisions of sections one and two of this act.
  S 4. This act shall take effect on the first of January next  succeed-
ing the date on which it shall have become a law.
