AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
  prohibiting  the sale of beer and wine products at retail for consump-
  tion off the premises between midnight and six o'clock in the morning

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The alcoholic beverage control law is amended by adding a
new section 105-d to read as follows:
  S 105-D. PROHIBITION ON THE RETAIL SALE OF BEER AND WINE PRODUCTS  FOR
CONSUMPTION  OFF  THE PREMISES DURING CERTAIN HOURS. EXCEPT AS OTHERWISE
PROVIDED BY SECTION ONE HUNDRED FIVE-A OF THIS ARTICLE, NO PERSON, FIRM,
CORPORATION, LIMITED  LIABILITY  COMPANY,  OR  OTHER  ENTITY  HOLDING  A
LICENSE TO SELL BEER AT RETAIL FOR CONSUMPTION OFF THE PREMISES PURSUANT
TO  SECTION FIFTY-FOUR OF THIS CHAPTER OR HOLDING A LICENSE TO SELL BEER
AND WINE PRODUCTS AT RETAIL FOR CONSUMPTION OFF THE PREMISES PURSUANT TO
SECTION FIFTY-FOUR-A OF THIS CHAPTER SHALL SELL, OFFER FOR SALE, OR GIVE
AWAY BEER OR WINE PRODUCTS AT RETAIL BETWEEN  TWELVE  MIDNIGHT  AND  SIX
O'CLOCK ANTE MERIDIEM.
  S  2.  This  act shall take effect on the thirtieth day after it shall
have become a law.
